Understanding H-1B Public Access Files and H-1B Wage Requirements

Every H-1B practitioner must understand Public Access Files and wage requirements. Failure to comply with these requirements can result in civil penalties, back wages, or debarment from the H-1B program. The panel discusses best practices for creating and maintaining Public Access Files and complying with H-1B wage obligations.

Learning Objectives:

  • Create a Public Access File, with all its required contents, within one day of filing a Labor Condition Application.
  • Understand the contents of the Public Access File.
  • Understand employer wage obligations.
  • Maintain the Public Access File for the required retention period.
